Terms of Service
These Terms govern your use of Pomarola ("the Service"). By creating an account or using the Service you accept these Terms. If you do not agree, do not use Pomarola.
1. Who can use Pomarola
The Service is for people aged 18 or older only. By using it you represent that you are at least 18 and that your account information is truthful. You are responsible for all activity under your account.
2. The Service
Pomarola provides video rooms for co-study and co-work. The Service is provided "as is" and "as available". We may modify, suspend or discontinue features at any time, with no guarantee of continuous availability.
3. Your conduct
You must follow the Code of Conduct. Prohibited: harassment; sexual, violent, hateful or illegal content; involving minors; recording or capturing others without their consent; impersonation; breaching the Service's security or using it for spam or unauthorized automation.
4. Your content and your camera
You are solely responsible for what you transmit via camera, microphone or chat. You grant us a limited license to transmit that content live to the people present in your room, solely to operate the Service. Pomarola does not record session video or audio.
5. Moderation and enforcement
To protect the community we may remove, mute, restrict or suspend accounts and rooms at our discretion, with or without notice. Community moderation (kick votes) and an operator safety override exist. We have no obligation to monitor content, but we may.
6. No warranties
To the fullest extent permitted by law, the Service is provided without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, availability or error-free operation.
7. Limitation of liability
To the fullest extent permitted by law, Pomarola and its operators are not liable for indirect, incidental, special or consequential damages, nor for data loss, lost profits or harm arising from other users' conduct. Our total aggregate liability will not exceed the amount you paid us in the last 12 months (or USD 0 on the free plan).
8. Indemnification
You agree to indemnify and hold harmless Pomarola and its operators from any claim, damage or expense (including reasonable legal fees) arising from your use of the Service, your content, or your breach of these Terms.
9. Termination
We may suspend or terminate your access at any time for a breach or for safety reasons. You may delete your account anytime from Settings; associated data is removed per the Privacy Policy.
10. Changes to these Terms
We may update these Terms. If changes are material, we will give reasonable notice. Continued use after an update means you accept it.
11. Governing law and jurisdiction
These Terms are governed by the laws of Chile. Any dispute will be submitted to the ordinary courts of Santiago, Chile, without prejudice to any non-waivable consumer rights the law grants you.
